When Does a Neighborhood Dog Legally Become a Nuisance?

According to the town bylaws, much of it comes down to the poop.

Question: A Tewksbury Patch reader has been wondering about the problem of dogs roaming free in his neighborhood. He wanted to know what the town bylaws said about nuisance dogs and the responsibilities of dog owners.

Answer: The town bylaws address the issue in the following way:

6.04.110 Public Nuisances

Every owner or keeper of a dog shall exercise proper care and control of his/her dog so as to prevent said dogs from becoming a public nuisance. It shall be deemed a public nuisance if any dog should trespass upon private property and deposit feces thereon, unless immediately removed by the owner or keeper of said dog.  (This is copied under section 6.04.110 - Laws Pertaining to Dogs Booklet)

So there you have it. Keep control of your dog and make sure it doesn't go wandering into other people's yards. If your fluffy bundle of joy does happen to deposit a "little present" on someone else's property, clean it up immediately or you could be subject to a nuisance complaint.

Most of the public nuisance I experience is actually an owner issue. They either don't pick up after their animal after they defecate or the animal is a constant "barker" because of lack of care and training. These owners leave their animals outside to bark constantly. If you have a dog that constantly barks there is a problem. If you don't want to spend quality time with your animal and properly train it then get rid of it. Have some respect for yourself, your animal and your neighbors. Don't let your dogs bark outside all day long and pick up after them. The world does not revolve around you!.

my neighbors dog is constantly getting out of his house. leaving feces all over my yard gets lost and is NEVER on a leash. Besides the fact this dog (who my family loves) always charges after my dog while my dog is in a leash. Love the dog but perhaps some dog owner education for the owner is a good thing. How would I approach this?

There have been wandering dogs around Brooke St and I dislike taking walks with my dog and baby when these dogs are allowed to roam free. You just never know how your own dog or the mystery wandering dog will react to one another and if there could be an incident or fight that could hurt either dog, a child or adult. In addition you have no idea if the owners that let their dogs roam free around vaccinate their animal. Mike T - I bet the people that let their dogs out all day long barking and crapping everywhere are the same oblivious people standing in the middle of the aisle at Market Basket yapping on their cell phones about pointless stuff. Italian Mama - any neighbor that blatant, I'd call up the Animal Control officer right away and see if you have to give your name or can remain anonymous. Chances are if you approach them they won't be very receptive. People are often very defensive about their canines when you try to tell them they are doing something wrong.

I had a problem with one of my neighbors' dogs. It attacked my cat in my yard and also attacked my dog who had a surgical collar on and was on a leash in my yard. they would repeatedly let it loose even after they were informed of the attacks. The only help I received was from the Dog Officer. He would come out right away and I assume fine them when he found out that the dog was indeed loose. Thank you Mr. Dog Officer!

the dog officer is a wonderful young man I've had to contact him in the past for another incident. CM9 your right the owner wasnt receptive at all when his dog was charging after another dog i had previously and I told him to keep his dog on a leash..i went to apoligize with some dog treats for his dog as i turned he spit at me..nice huh..yeah im not fooling around anymore.

I was told by my neighbor that the animals had to learn to get along. Of course, they had the bigger and more aggressive animal!

every time you see the dog loose, call animal control. Tell them you're reporting a wandering/lost dog.

Animal Control was very effective. After a while, the dog was hit by a car. Did that teach them anything? No! They got another dog and it too was hit by a car and killed!

I have the found the animal control officer to be very effective. If he is not on duty call irthe police non-emergency number. They work together. I have a neighbor who tied their dog up way out back which was closer to my yard. After a few calls and visits by TPD I haven't heard the dog in a couple months. I have another neighbor who has a yapper that they have penned up off their deck stairs. Wakes my house up everyday between 6 and 7am. Nice huh. I have started the process of disciplining the owners. They shouldn't be allowed to have a dog. They don't care for it or the people who live around it. There is nothing worse than a nuisance dog and owner but there is help. Most people are afraid to call. You can stay anonymous so call!

Unfortunately it is hard to catch a dog walker that allows their dog to drop their presents on your lawn and have the dog officer out to see them when they do it. Hopefully this article will be seen by enough of those who are guilty of allowing their dogs to leave their feces on the lawns of other people and know exactly how wrong this is. I have my own dog that stays behind a fence. I clean up after my own pet and don't want to clean up after yours. Please clean up after your dog so everyone can habitat peacefully.

In regards to the incident on the news about the jerk who shot the neighbors spaniel that was "worrying" his caged rabbits - that should have been a crime. If the dog was one of the known aggressive breeds, then I can see being fearful for yourself and not shooing the dog away, but a spaniel? I hope Karma gets that guy - just because it was legal didn't make it right.

Further, I have a large dog so I have a fenced yard. I didn't want to have to tie the dog out, so I got a fence. If you have constant problems of people not picking up after their dog or neighbor dogs invading your private property, set up a surveillance camera - even a web cam and get video of it. Nothing like social networking to out the jerk who doesn't pick up after his pooping pup. Plus, maybe they could be fined based on the video.

About the spaniel, shooting the dog was wrong. I luv dogs. Why was he in neighbors yard? It was terrible heartless thing he did.so why was dog there? Its a shame.

My neighbors put their dog out to bark beginning at around 6:30 am. The dog is obviously not trained and barks at everything and nothing at all - shows teeth and snarls when dogs are walked by on leashes. While they have a fenced yard and do not have to tie the dog up, they seem completely oblivious to its other bad behaviors. On the rare occasion that one of the owners realizes the dog is being obnoxious, they step outside and PET HIM and walk right back inside (nothing like REWARDING him for his constant barking!) Absolutely clueless! Also, this is a large breed and (sadly) it is only excercised about 3-4x a year. I don't understand why people get these animals if they aren't going to care for them?! Is it just a status thing to have an "AKC" dog these days? Seems terribly selfish...
